END USER LICENSE AGREEMENT

This agreement is between you and Avalon Holding Partners LLC, a Massachusetts limited liability company doing business as Avalon Partner ("we", "us"). By installing or using Castdeck (the "Software") you agree to these terms. If you do not agree, do not install or use the Software.

Free: you may download the Software and use its Free features on as many computers as you like, for personal and commercial streaming, at no cost and with no time limit.

Pro: a one-time purchase gives you a license key that unlocks the Pro features on up to 3 computers you own or control at the same time, for you or your own channel or business. Phones and tablets that only open the panel do not count toward the 3.

Your purchase includes every version released during the 12 months after it. After those 12 months, Pro keeps working, without time limit, in every version released during that period. Versions released later run as Free until you buy another 12 months of updates. Renewing is optional and never automatic. If you renew after your updates ended, the new 12 months start on the day you renew.

• Keep your key to yourself. Do not share, publish or resell it.
• The Software activates your key online once on each computer. After that the license is checked on your computer, and the Software asks our license server for a fresh license at most every 30 days. If the server cannot be reached, Pro stays on.
• To move Pro to another computer, deactivate it on one of yours first, or write to us.
• Activating sends the key, a device code and the program version to our license server. The privacy notice explains this in full.
• We may switch a key off if it was refunded, charged back, bought with a stolen card, or shared publicly. A switched off key stops unlocking Pro at that computer's next license check, and the Software then runs as Free.

You may not: (a) remove, bypass or tamper with the license check, or give others a way to; (b) sell, rent, sublicense or redistribute the Software or your license key, or pass the Software off as your own product; (c) use the Software in a way that breaks the law or the rules of the platforms you stream to.

You own everything you make and show with the Software: your streams, texts, logos, sounds and results. You are responsible for what you show on stream.

The Software works with programs and services we do not control, such as OBS Studio, TikTok LIVE Studio, Social Stream Ninja (a separate free program under its own license, not bundled), Twitch, YouTube, Kick, TikTok, Discord and Stripe. Their terms apply to your use of them, and they may change in ways that stop a feature of the Software from working.

Kick chat and TikTok chat are read through unofficial feeds, not public APIs. The platforms' terms may not allow this, and a change on their side can break it at any time. You use these features at your own risk, and only after ticking the risk note in the Software.

TikTok LIVE Studio control is an experimental, optional module, off by default. It presses LIVE Studio's buttons from outside, through a debugging port on your computer. TikTok's terms do not allow automating their software, and TikTok could restrict your account or your LIVE access because of it. You use that module at your own risk, and only after reading the risk note in the Software. The Software works fully without it.

Support is provided at Joshua.amado@avalonpartner.com on a reasonable-effort basis. If you lose your key, write from the email address you paid with and we send it again.

You can ask for a refund within 14 days of purchase, no questions asked. Write to Joshua.amado@avalonpartner.com from the email address you paid with. A refund switches the key off, and so does a chargeback. A refunded renewal takes away the 12 months it added; the key itself keeps working.

Prices are shown on our website and at checkout, including or excluding tax as shown there. Payments are processed by Stripe.

THE SOFTWARE IS PROVIDED "AS IS", WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SOFTWARE IS FREE OF BUGS, THAT IT WORKS WITH EVERY VERSION OF THE PROGRAMS AND PLATFORMS ABOVE, OR THAT A STREAM NEVER GOES WRONG. TEST YOUR SETUP BEFORE YOU GO LIVE.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE ARE NOT LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL OR CONSEQUENTIAL DAMAGES, INCLUDING LOST INCOME, LOST STREAMS OR ACCOUNT RESTRICTIONS BY THIRD-PARTY PLATFORMS. OUR TOTAL LIABILITY IS LIMITED TO THE AMOUNT YOU PAID FOR THE SOFTWARE IN THE 12 MONTHS BEFORE THE CLAIM. NOTHING IN THESE TERMS LIMITS RIGHTS YOU HAVE AS A CONSUMER THAT CANNOT BE LIMITED BY LAW.

We may update these terms for new versions. The terms that applied when you got a version keep applying to that version. You may stop using the Software at any time. This license ends automatically if you break these terms, and we may then switch your key off. If we ever stop selling the Software, the versions you have keep working with the license already on your computers. Sections 5, 10, 11 and 13 survive.

These terms are governed by the laws of the Commonwealth of Massachusetts, without regard to conflict-of-law rules. If you are a consumer, you also keep the protection of the law where you live.
